[ANN] The Fury .PvP. Project
 
It gives me great pleasure to announce the opening of the The Fury .PvP. project. The Fury .PvP. is a fast paced action packed competitive PK game. Set in the ancient realm of Engen Wu, The Fury .PvP. draws influence from Asian mythology, spiritualism and martial arts with dark fantasy undertones throughout the entire game.

The design philosophy used for The Fury .PvP. has been to keep things as simple as possible. To have systems that are easy to understand, that are not overtly technical or bring in needless complexity to the game play and design. This game is one that it is intended for gamers from non D&D and text mud backgrounds, it is intended to be fun and and have easy to understand race and class selections, with classes only having the necessary skills and spells to see them competitive from that outset with any race combination.

The Fury .PvP. is in a unique in that this game will offer over 8 week periods competitive PK where players can win cash and prises. The Fury .PvP.has partnered with a game retailer to promote and distribute the game and to donate the cash and prises on offer.

We wish to invite applications from interested and talented individuals who posses skills across a wide variety of areas to join this project. The individuals we see should be able to work autonomously, be able to follow instruction, have excellent written communication skills and be able to work effectively to meet deadlines. Checkable references and or examples of work would be considered highly.

Builder: should have a proper understanding of English grammar, posses a creative imagination, able to describe objects, rooms and monsters within an Asian fantasy setting. Familiarity of smaug olc and or oasis olc would be highly regarded.

Editor: should have the ability to be able to test and come to a working understanding of all aspects of the game, with minimal input or starting information. Be able to write help files, create web content, user guides, game announcements and news posts.

Writer: possess a proper understanding of English grammar, posses a creative imagination, be able to take fragments of ideas and stories and form them into a cohesive whole. To be able to work within the developed story to bring aspects to the game including but no limited to instance zones and quest, including stories area maps and design information.

Artist: suitably skilled in all aspects of graphical arts, required to develop web content and in game graphical content. Familiarity with Asian mythology and fantasy creatures would be well regarded as would be ability to research such information.

All applications should be titled “Fury .PvP. Application” and sent to eldhamud <AT> gmail <dot> com. The game server can be located at fury.eldhamud2.org 8000. All aplications will be replied to within 24 hours of receipt.

I'd be careful with the name of this project. You're almost certainly violating copyrights owned by Auran, the developer who develops and publishes .

A quick check on the TM database would reveal that auren have trademarked UNLEASH THE FURY, and the word FURY, and while im not intending on registering my game name as a trademark, the name that is currently being used is a development working name only and it is fully expected to change when the game in publicly released.

The TM of the word FURY would refer to the game they released under that name and
UNLEASH THE FURY would refer to the game you also pointed out. I don't feel however that The Fury .PvP. imposes on either of those trademarks even tho they share a common word FURY.

By trademarking it for use in the area you're going to use it commercially in (trademarks don't exist outside of the realm of commercial applications). Nobody else can use the word 'Apple' in conjunction with computers, consumer electronic products, etc.

In my opinion they shouldn't be able to try redefine words like that. Apple is a fruit and that is it. If you are interested in android research... you today would get tons of hits about Google's Android - a mobile platform - which has nothing with the original meaning of the word to do. Thank you very much Google :mad:.

By the way I remember from an earlier discussion here on TMS, I think related to God Wars, that if a non commercial project pick some name then any commercial entity could trademark it and force you to do a name change. So I guess best is to make sure from the start that it won't be too difficult to change name of your non commerical MUD project?

I'd suggest looking into copyright and trademark laws in the country where you reside. You can find pretty much the set law on the internet and go by that. As for names. That's pretty easy. Just be the first to send in your copyright notice.

Well, not really. You can't copyright a name, a slogan, a short phrase, a title, etc.

In order to protect a name it you need to trademark it (or servicemark it), and in order to register a trademark or a servicemark you need to be using or credibly planning to use soon the name commercially. It's also not enough to be the first to register it, since in the US, for example, one can establish a trademark through commercial use.

Trademarks aren't attempting to redefine a word. They exist to reliably identify to consumers the origin of commercial goods or services. So, for instance, when a consumer sees the trademarked Apple logo on a computer or piece of consumer electronics, the consumer is able to reasonably expect that Apple had something to do with the product. Other companies are still able to use the word apple, just not in the same areas that Apple's trademark extends to. If you ran a fruit-harvesting service (provided labor to fruit-tree farmers) and nobody else had trademarked Apple in conjunction with fruit-harvesting or related activities, you'd be good to go on using it.

Well, that's the responsibility of the search provider. They're the ones providing you with the hits.

I'm not an attorney (though I do deal with trademark law somewhat frequently with our attorneys) but I believe that's the case, yes (though as always with the law there may be some corner cases that are exceptions). Trademark law exists to protect and promote commerce, so a hobby project isn't going to receive protection from trademark/servicemark law. Note the distinction is whether it is used in commerce though, so a non-profit that's engaging in commerce (World Wildlife Fund, Red Cross, etc) is still able to trademark its name, logo, etc.

(As always btw, the details really depend on what country's laws you're talking about. The above is directly about the US, though it's not much different in Canada and Europe, for instance.)
