Well, I think a lot of the stock muds (mine included) have infringing areas, but they can be whipped out quite easily so the mud itself wouldn't have to shut down.

As for those that base themselves entirely around someone else's intellectual property though, yes, they could certainly be at risk. They just have to hope they fly under the radar really.
