The exerpt you've quoted from our terms and conditions is meant to protect us legally (from being sued) in the event of something beyond our control happening, such as a hard disk failure. In a legal sense, the service doesn't come with a warranty. This is typical in all of the ISP and web hosting terms and conditions that I've read (including other MUD hosting providers, such as BetterBox).
Although we don't have a warranty in a legal sense, we do stand behind the reliability of our service with a 99.9% uptime guarantee:
